2. Service Level Agreement (SLA) and Service Availability

DentoSol aims to provide reliable access to its cloud-based services, scheduling APIs, digital dental records, and associated platform features.

Any uptime commitment, including a 99.99% operational uptime target, shall apply only where expressly agreed in a separate service-level agreement between DentAssure Health Plans Private Limited and the relevant customer.

Planned maintenance may be scheduled during off-peak hours, with advance notification where reasonably practicable.

Service availability may be affected by scheduled maintenance, emergency maintenance, third-party service outages, internet connectivity issues, cyber incidents, circumstances beyond our reasonable control, or other technical factors.

DentAssure Health Plans Private Limited will make reasonable efforts to maintain service continuity, address technical issues, and communicate significant service disruptions to affected customers where appropriate.

3. Clinic Subscriptions, Pricing, and Chair Seat Licenses

DentoSol may offer subscription plans based on factors such as the number of registered dental chairs, clinic branches, authorized users, selected features, and applicable service requirements.

Subscription fees, billing frequency, plan inclusions, applicable taxes, and other charges will be communicated to clinics during subscription selection or through the applicable commercial agreement.

Clinics may upgrade, downgrade, or modify their subscriptions, including eligible chair seat licenses and branch registrations, subject to the available plans, applicable pricing, and platform procedures.

Any additional charges resulting from subscription changes will be communicated to the clinic before the changes take effect, where applicable.

Clinics are responsible for ensuring that their subscription details, billing information, and registered operational details remain accurate and up to date.

4. Account Registration and Authorized Access

Clinics and users must provide accurate information when registering for DentoSol and must keep their account details updated.

Access to the platform is limited to authorized users in accordance with their assigned roles and permissions.

Users are responsible for maintaining the confidentiality of their login credentials and for activities performed through their accounts, except where applicable law provides otherwise.

Clinics must promptly notify DentoSol if they become aware of unauthorized account access, compromised credentials, or suspected security incidents.

DentAssure Health Plans Private Limited reserves the right to restrict or suspend access where reasonably necessary to protect the platform, users, patient information, or the security and integrity of its services, subject to applicable law.

5. Clinical Responsibility and Professional Disclaimer

DentoSol provides digital practice management tools, appointment scheduling, digital charting, treatment documentation, and related administrative functionalities to support dental clinics and healthcare professionals.

DentoSol is not a substitute for professional dental judgment, clinical examination, or independent medical decision-making.

All clinical diagnoses, treatment plans, prescriptions, referrals, and other professional healthcare decisions remain the responsibility of the appropriately qualified and licensed dental practitioner.

Healthcare professionals must independently review relevant patient information and verify the accuracy of clinical records before making treatment decisions.

Any automated recommendations, scheduling assistance, AI-powered features, or other software-generated outputs must be reviewed by the appropriate professional before being relied upon in a clinical context.

DentAssure Health Plans Private Limited does not guarantee a particular clinical outcome from the use of DentoSol.

6. Patient Data Ownership and Data Protection

Clinics retain their rights and ownership interests in patient records, dental case histories, FDI dental charts, treatment documentation, diagnostic information, and other data submitted to DentoSol, subject to applicable law and the rights of patients and other data subjects.

DentAssure Health Plans Private Limited does not claim ownership of clinic-generated patient records merely because those records are stored or processed through DentoSol.

Clinics are responsible for ensuring that they have the appropriate legal basis, permissions, authorizations, and patient consents, where required, to collect, upload, access, and process personal and health-related information through the platform.

DentAssure Health Plans Private Limited will process personal information in accordance with the DentoSol Privacy Policy and applicable data protection laws.

Clinics and authorized users must take appropriate measures to prevent unauthorized access, disclosure, misuse, or alteration of patient information.

7. Data Export and Portability

Subject to applicable law, account status, technical feasibility, and any applicable contractual requirements, clinics may request an export of their available clinic data when discontinuing their subscription or terminating their account.

Where the platform supports the relevant data types, exports may be provided in commonly used formats such as CSV or JSON. Medical images and specialized clinical files may require their original or compatible formats.

DICOM exports will be available only for data stored in or supported by the platform in that format.

Standard data exports will be provided without an additional export fee where expressly included in the applicable subscription terms or customer agreement. Any applicable charges or limitations will be communicated before processing the request.

Clinics should request and verify their required data exports before account closure. Certain records may need to be retained for legal, regulatory, security, or legitimate recordkeeping purposes, subject to applicable law.

8. Subscription Cancellation, Account Deletion, and Termination

Clinics and authorized users may request subscription cancellation or account termination at any time in accordance with their applicable subscription terms, commercial agreements, and our Privacy Policy.

Self-Service Account Deletion: Users (including Dental Clinics, Organizations, Patients, and Dental Laboratories) may request the permanent deletion of their account and associated messaging subscriptions directly through the application by accessing Settings → Security & Account → Danger Zone, or by submitting a written request to privacy@dentosol.in.

Any notice period, refund eligibility, outstanding payment obligations, or cancellation charges will be governed by the applicable subscription terms and our Cancellation & Refund Policy.

DentAssure Health Plans Private Limited may suspend or terminate an account for material violations of these Terms and Conditions, non-payment, fraudulent activity, security risks, unlawful use, or other legally justified reasons, subject to applicable law and contractual obligations.

Where reasonably practicable, clinics will be notified of the relevant issue and given an opportunity to resolve it before termination, unless immediate action is necessary for security, legal compliance, or other legitimate reasons.

Account termination does not automatically eliminate any legal obligations relating to patient records, data protection, record retention, or outstanding payments. Historical tax invoices and statutory medical records remain subject to applicable legal retention mandates.
